2. Definitions

User: any person browsing the Website.
Customer: the User who purchases a guide or digital content.
Consumer: a natural person acting for purposes outside their trade, business or profession.
Professional / Business Customer: a person acting in the exercise of their business, commercial, craft or professional activity.

3. Purpose of the Website and nature of the content

The Website provides digital guides and informational content primarily intended for professionals operating in the pharmaceutical and regulatory sectors.

The guides (PDFs and digital materials):

  • do not replace official laws, regulations or guidelines issued by EMA, FDA, ICH, AIFA or other regulatory authorities;
  • do not constitute personalised legal, regulatory or quality consultancy;
  • do not guarantee specific outcomes (e.g. audit or inspection results), as these depend on the specific context and practical application.

4. Access to the Website and rules of use

The User undertakes to:

  • use the Website lawfully and in good faith;
  • refrain from unauthorised access attempts, large-scale scraping, reverse engineering or any activity that could compromise the security or availability of the Website;
  • provide accurate and up-to-date information when required during the purchase process.

GuideGxP reserves the right to suspend or restrict access to the Website in the event of abnormal or potentially harmful use.

5. Intellectual property and licence of use of the guides

All content on the Website (texts, graphics, logos, layouts, guides and digital files) is protected by copyright and intellectual property laws.

Unless otherwise stated, upon purchase the Customer is granted a personal, non-exclusive and non-transferable licence to use the guide, limited to:

  • consultation and internal use (personal or within the organisation) for the intended purposes;
  • printing solely for internal use, where technically permitted.

By way of example, it is strictly prohibited to:

  • publicly share or distribute the files to third parties (uploading, email distribution, groups, shared drives, marketplaces);
  • reproduce, distribute, sell, rent or transfer the content;
  • remove watermarks, digital signatures or identifying elements, where present.

Any infringement may be pursued through appropriate legal channels.

6. Pre-contractual information and conclusion of the online contract

The online purchase procedure includes entering the required information, reviewing the order and making payment using the methods available at checkout.

The contractual terms and relevant information are made available to the Customer in a manner that allows their storage and reproduction.
Where applicable, prior to submitting the order, GuideGxP provides information regarding the steps to conclude the contract, contract storage, error-correction tools and available dispute resolution mechanisms.

7. Delivery of digital content

Products are supplied exclusively in digital format (e.g. PDF).

After successful payment, the Customer receives:

  • a download link and/or access to a restricted customer area;
  • an order confirmation email (subject to technical issues, spam filters or incorrect data provided).

It is the Customer’s responsibility to verify:

  • the accuracy of the email address provided;
  • the compatibility of their device with the file format (e.g. PDF reader).

8. Conformity of digital content and support

For contracts with Consumers relating to digital content or digital services, the rules on conformity set out in the national implementation of Directive (EU) 2019/770 shall apply.

In the event of technical issues (e.g. corrupted file, non-working link) or duly justified reports of lack of conformity:

  • contact info@guidegxp.com, indicating the order number, the email address used for the purchase, a description of the issue and screenshots where available;
  • GuideGxP will provide support and, if necessary, an alternative means of access or download.

9. Limitation of liability

GuideGxP takes care to ensure the quality and accuracy of its content, but does not guarantee that:

  • the information is free from errors or always fully up to date with regulatory changes, interpretations or inspection practices;
  • use of the guides will lead to specific results in the Customer’s context.

To the extent permitted by law, GuideGxP shall not be liable for indirect or consequential damages (e.g. loss of profit, business interruption, inspection outcomes) arising from the use of the content, except where liability cannot be excluded by law.

10. Links to third-party websites

The Website may contain links to third-party websites (e.g. regulatory authorities, platforms, tools). GuideGxP has no control over such websites and accepts no responsibility for their content, availability or policies.

Personal data are processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Italian data protection laws.

  • If the Customer is a Consumer: mandatory jurisdiction lies with the court of the consumer’s place of residence or domicile, as provided by law.
  • If the Customer is a Professional: exclusive jurisdiction for any dispute shall lie with the Court of Teramo (Italy), subject to mandatory legal provisions.

14. Amendments to the legal notice / terms

GuideGxP may update this legal notice and these terms to reflect regulatory changes or modifications to the service.
The version published on the Website applies at the time of browsing; for purchases, the version accepted at the time of order shall prevail, subject to mandatory legal provisions.
